INFORMATION ON THE PROCESSING OF CANDIDATES’ PERSONAL DATA/ PRIVACY POLICY
Pursuant to articles 13 and 14 of EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data (hereinafter: the “Regulation”), and applicable national legislation, Ecogest S.p.a. (hereinafter: “Ecogest”), in its capacity as Data Controller, Informs you hereby of the following with regard to the collection and subsequent use of your personal data in the context of the staff search and selection process.
- CATEGORIES AND SOURCE OF PERSONAL DATA
Ecogest collects and processes your personal data provided by you:
- by your filling in of the online form available on the “Work with us” page, www.ecogestspa.com/work-with-us/ of our website and, if necessary, by your sending of attachments;
- during any subsequent interviews which may take place.
Ecogest invites candidates not to include in the compilation of the form personal data revealing racial or ethnic origin, religious, philosophical or other beliefs, political opinions, membership of parties, unions, associations or organizations of a religious, philosophical, political or trade union, as well as personal data disclosing health or sex life (so-called special categories of personal data). Such data, if voluntarily entered or disclosed, will be deleted unless their use is strictly necessary for the pursuit of the purposes of research and selection of personnel and the establishment of the employment relationship (for example, in case of belonging to certain protected categories), within the limits and in compliance with the provisions expressly provided for by law.
If among the data indicated by you there are also data relating to third parties (for example, contacts to be contacted for previous work experience) you must have previously ensured that you have obtained the consent of these natural or legal persons to be contacted by Ecogest.
- PURPOSE AND LEGAL BASIS OF THE PROCESSING
The personal data indicated above will be collected and used only for the purposes of evaluating your application in the context of personnel recruitment and selection activities and, should you be suitable for the open position, for the purposes of establishing the employment relationship and fulfilling the legal obligations relevant to this relationship. For these purposes, the legal basis of the processing is the need to provide feedback to your application, fulfill the legal obligations arising from the activity of personnel search and selection and pursue the legitimate interest of Ecogest consisting in the activity of personnel search and selection.
With reference to the particular categories of personal data we specify that Ecogest, where strictly necessary and within the limits and in compliance with the law, will use such data exclusively to fulfill or require the performance of specific obligations or to perform specific tasks provided for by European Union legislation, laws, regulations or collective agreements for the management of the employment relationship, as well as legislation on social security or health and safety at work, within the limits provided by applicable national legislation and ensure equal opportunities at work. In this case, the legal basis for the processing is the need to fulfil the obligations laid down by law.
- NATURE OF DATA PROVISION
If you decide to apply, you will be free to provide any personal data that you consider most suitable for the purpose. However, in the event of failure to provide personal data necessary for the purposes of your identification, Ecogest may not be able to evaluate your application in full and complete the personnel selection process.
The submission of your application using the send button on the “Work with us” page www.ecogestspa.com/work-with-us/ of our website is completely spontaneous and optional.
- METHODS OF DATA PROCESSING AND STORAGE
Personal data will be processed by electronic means and, where necessary, in paper format and stored in our database, protecting your privacy and your rights through the adoption of appropriate technical and organizational measures to ensure a level of security appropriate to the risk.
Your personal data will be stored for a period of time not exceeding that strictly necessary to evaluate your application for the purpose of a possible inclusion in the staff of Ecogest (and, in any case, not exceeding 12 months), after which they will be removed from both computer systems and any paper files, without prejudice to further conservation obligations under applicable law.
- RECIPIENTS OF THE DATA
For the purposes indicated above, the following natural or legal persons may become aware of your data:
– the personnel of Ecogest authorized and duly trained, also with regard to compliance with security measures and confidentiality obligations;
– the administrative departments of Ecogest, including the general manager, who is the direct line manager of the position for which your profile may be considered.
Your personal data will not be disclosed or transferred outside the European Union.
- YOUR RIGHTS
As an interested party/data subject, you have the right pursuant to Articles 15-21 of the Regulations to:
– receive confirmation of the existence of your personal data, access their contents and obtain copies thereof (right of access);
– update, modify and/or correct your personal data (right of rectification );
– request the cancellation or restriction of the processing of data processed unlawfully, including data whose retention is unnecessary for the purposes for which they were collected or otherwise processed (right to erasure and right to restriction);
– withdraw consent, where given, at any time and without prejudice to the lawfulness of the processing based on consent given before the withdrawal (right to revoke consent);
– within the limits of the provisions of the Regulations, to receive a copy of the data in electronic format that concern you returned in the context of the selection process (e.g. data relating to previous work experience) and request that such data be transmitted to another data controller (right to data portability);
– of objecting to the processing of your data should Ecogest decide to carry out direct marketing or profiling activities (right to object).
